Stallholder Terms & Conditions

These Terms and Conditions apply to all stallholders at markets operated by The Mewburn Group Limited under the Mewburn Markets brand. By submitting a stallholder application and/or attending any Mewburn Markets event, you agree to be bound by these Terms and Conditions.

Acceptance & Allocation

Submission of an application does not guarantee a stall. Acceptance is at the sole discretion of Mewburn Markets. You will be notified of acceptance by email. A stall is only confirmed once payment has been received in full by the stated deadline.

For Takapuna Sunday Farmers Market and Britomart Saturday Farmers Market, stall spaces are limited and operate on a one-in, one-out basis. There may be a significant waiting period between application and acceptance. We appreciate your patience and will contact you as soon as a suitable space becomes available.

Stall Fees

Stall fees vary by market and stall type. Current fees are set out in the tables below. Fees are subject to change and will be confirmed in your acceptance email.

All fees are in New Zealand Dollars (NZD) and are inclusive of GST where applicable.

Market Hours & Setup

3.1 Takapuna Sunday Farmers Market

Trading 7am–12pmPack-in from 5:30amSet up by 6:45am or lose your space
  • Trading hours: Sunday 7am–12pm
  • Pack-in from 5:30am. Stallholders must be on-site and set up no later than 6:45am.
  • If you have not arrived by 6:45am, your space may be reallocated without refund.
  • No driving on the licensed market area unless specifically approved in writing by the organisers.
  • Pack-out begins at 12pm. Early pack-up is not permitted.

3.2 Britomart Saturday Farmers Market

Trading 8am–2pmPack-in from 6:30amSet up by 7:45am or lose your space
  • Trading hours: Saturday 8am–2pm
  • Pack-in from 6:30am. Stallholders must be on-site and set up no later than 7:45am.
  • If you have not arrived by 7:45am, your space may be reallocated without refund.
  • All vehicle movements onto or off the market site must be guided by a Mewburn Markets marshall wearing a hi-vis vest. No vehicle is to move — forward or in reverse — without being guided by a marshall. Failure to comply may result in immediate removal from the market.
  • Pack-out begins at 2pm. Early pack-up is not permitted.

3.3 Friday Night Vibes — Trusts Arena, Henderson

Trading 4pm–9pmPack-in from 2pmSet up by 3:30pm or lose your space
  • Trading hours: Friday 4pm–9pm
  • Pack-in from 2pm. Stallholders must be on-site and set up no later than 3:30pm.
  • If you have not arrived by 3:30pm, your space may be reallocated without refund.
  • Pack-out begins at 9pm. Early pack-up is not permitted.

Payment

Payment must be made in full by the deadline stated in your confirmation or invoice or, by agreement, on the day of the market. Unpaid stalls will be offered to other applicants without notice.

Permanent Stallholders follow the payment terms set out in Section 6 rather than this section.

Cancellations & Absences — Casual Stallholders

This section applies to casual (non-Permanent) stallholders. Permanent Stallholders are governed by Section 6.

5.1 Stallholder Cancellations

We understand that circumstances change. To cancel your attendance, tap the "I can't make it" button in any market email we've sent you, or notify us by email to markets@mewburnmarkets.co.nz as soon as possible. Charges depend on which market it is and when we hear from you.

No cancellation charge applies at this market.

No-shows — all markets. If you do not attend and have not told us beforehand, the full stall fee is charged. This applies at every market, including Friday Night Vibes.

Any charge arising from a cancellation or no-show is added to your costs at your next market.

Repeated unannounced absences or non-responsiveness may affect your future participation in any Mewburn Markets event.

5.2 Venue Conflicts — Friday Night Vibes Only

Friday Night Vibes is held at Trusts Arena, Henderson. In the event of a conflicting booking at the venue, Mewburn Markets reserves the right to cancel a scheduled market. We will provide a minimum of 2 weeks' notice in such circumstances. No charge will apply for market cancellations initiated by Mewburn Markets.

5.3 Weather Cancellations — Outdoor Markets

Takapuna Sunday Farmers Market and Britomart Saturday Farmers Market are held outdoors and are subject to weather conditions. Where Mewburn Markets determines that forecast or on-the-day conditions pose a safety risk or make trading impractical, we reserve the right to cancel that week's market. Where possible, this decision will be communicated by 5pm the Thursday before the market. No charge will apply for a market cancelled due to weather.

Permanent Stallholders

Permanent Stallholder status is a standing arrangement offered at Mewburn Markets’ sole discretion, giving a stallholder a reserved, ongoing space at one specific market. It is separate from, and takes precedence over, the casual terms in Section 5.

6.1 Definition

A Permanent Stallholder is a stallholder who has been granted a fixed, recurring space at a named Mewburn Markets event on an ongoing weekly basis. Permanent Stallholder status applies to one specific market and one specific space, and is not transferable between markets, spaces, or businesses without Mewburn Markets’ written consent.

6.2 Attendance

Permanent Stallholders are expected to attend every trading week at their designated market, other than approved holiday absences under clause 6.5.

6.3 Payment

Fee is payable weekly or monthly, regardless of attendance.

Permanent Stallholders pay their stall fee weekly or monthly, as agreed in writing with Mewburn Markets. This fee is payable regardless of attendance — it is not contingent on the stallholder being present on any given week, except where an approved holiday absence applies under clause 6.5. Missed or late payment may result in immediate loss of Permanent Stallholder status and reallocation of the space, at Mewburn Markets’ discretion.

6.4 Space Guarantee

In return for the commitment in 6.2 and 6.3, Mewburn Markets guarantees the Permanent Stallholder’s space will be held and made available to them at every market, and will not be reallocated to another stallholder — casual or otherwise — except during an approved holiday absence under clause 6.5.

6.5 Holidays & Approved Absence

Give at least 10 days' written notice before the absence.

A Permanent Stallholder may take a break from attending, provided Mewburn Markets receives no less than 10 days’ written notice before the market date(s) they will be absent. Where this notice is given:

  • The Permanent Stallholder’s fee remains payable as normal under clause 6.3, unless otherwise agreed in writing.
  • Mewburn Markets may offer the space to a casual stallholder for the duration of the absence.
  • The space reverts to the Permanent Stallholder on their return, with no requirement to reapply or requalify.

Notice of less than 10 days does not release the Permanent Stallholder from their payment obligation for that week, and Mewburn Markets is under no obligation to backfill the space with a casual stallholder in that case.

6.6 Loss of Permanent Status

Mewburn Markets may revoke Permanent Stallholder status at its discretion in the event of repeated missed payments, unannounced absences without the notice required under 6.5, or breach of the Stallholder Standards & Conduct in Section 7. Where status is revoked, the space reverts to the general waitlist, and any future participation by that stallholder is on standard casual terms.

6.7 Review

Permanent Stallholder arrangements are reviewed periodically at Mewburn Markets’ discretion (e.g. annually or at market season change) and may be adjusted or ended on reasonable notice.

Before becoming a Permanent Stallholder, you will be asked to read and agree to this section by email.

Stallholder Standards & Conduct

All stallholders are expected to maintain a high standard of presentation and conduct. The following requirements apply at all markets:

  • Stalls must always be well-presented. For Gazebo stalls, tablecloths must be used and reach to the floor. Storage and equipment must not be visible to customers.
  • Mewburn Markets does not provide card payment facilities for your sales to customers; stallholders wishing to accept card payments must bring their own Eftpos/card machine.
  • All gazebo structures must be secured with ballast weights appropriate to the forecast weather conditions on the day of the market. Stallholders are responsible for ensuring their weights are sufficient for prevailing conditions — this is particularly critical in high-wind forecasts. Market staff reserve the right to require any gazebo deemed inadequately secured to be dismantled.
  • All tablecloths and coverings must be safely secured and must not pose a trip hazard.
  • Stallholders must remain at their stall for the full duration of the market. Early pack-up will result in exclusion from future markets.
  • All waste and rubbish must be removed by the stallholder. Leave your area clean.
  • Stallholders must be courteous and professional towards fellow stallholders, customers, and market staff.
  • Stallholders must maintain a reliable and regularly monitored email address for all market communications.
  • Vehicles must be unloaded with extreme care. Observe all site-specific vehicle rules outlined in Section 3.
  • Stallholders must comply with all relevant New Zealand legislation applicable to their business, including the Health and Safety at Work Act 2015, the Food Act 2014, and all applicable food safety and licensing requirements.

New Stallholders — Product Approval

If you are new to Mewburn Markets, we require the following before your first market:

If you sell food: a copy of your current Food Licence and your Food Safety Grade (A, B, or C)

Please email these to markets@mewburnmarkets.co.nz. Your stall will not be confirmed until these are received and approved.

Public Liability Insurance

We strongly recommend that all stallholders hold a current public liability insurance policy. While insurance is not a strict requirement, you must disclose to us whether you hold such a policy as part of your application. The Mewburn Group Limited accepts no liability for loss, damage, or injury arising from a stallholder's activities.

Indemnity

By participating in any Mewburn Markets event, you agree to indemnify and hold harmless The Mewburn Group Limited, its directors, employees, and agents against any loss, cost, claim, or expense arising from your activities as a stallholder, including but not limited to any breach of applicable law, food safety failure, property damage, or personal injury caused by you or your representatives.

Incidents & Accidents

All incidents or accidents — no matter how minor — must be reported to a Mewburn Markets host or market manager as soon as possible. Do not leave the market site before reporting an incident.

Market Cancellation by Organiser

Mewburn Markets reserves the right to cancel or postpone any market due to circumstances beyond its reasonable control. In such cases, no charge will apply to confirmed stallholders. See Sections 5.2 and 5.3 for the specific policies applicable to Friday Night Vibes venue conflicts and weather cancellations respectively.

Changes to These Terms

Mewburn Markets reserves the right to update these Terms and Conditions at any time. The current version will always be available at www.mewburnmarkets.co.nz. Continued participation in any Mewburn Markets event constitutes acceptance of the current Terms.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
